2006 Purchase Agreements. Collectively each of the following, as the same may be amended from time to time, (i) that certain Note and Warrant Purchase Agreement dated as of March 31, 2006, among the Issuer and the Purchasers, and (ii) that certain Note and Warrant Purchase Agreement, dated as of April 12, 2006, by and among the Issuer and the Purchasers.
