A123 Patent Rights. Shall mean the specific Patent Rights listed in Appendix D and any Patent Rights resulting therefrom and claiming continuing or divisional priority thereto. A123 Patent Rights exclude any patents based on continuation-in-part patent applications filed after December 2, 2005.
