Alliance Product. For purposes of this Supplemental Agreement and the 1999 Agreements, Alliance Product shall mean any product for use outside the Inhale Field involving the use of microstructures in connection with the direct intratracheal or direct pulmonary administration (e.g., via bronchoscope or endotracheal tube) of fluorocarbons or other liquids ("Liquid Dose Instillation") which if made, used, sold, or imported absent the license granted to Alliance by Inhale would infringe one or more Valid Claims of... the Assigned Patent Rights, the MediSpheres™ Assigned Patent Rights, or the Bioavailability Assigned Patent Rights, or which in material part uses, incorporates, or is based on the Assigned Know-How.
