APB PATENT RIGHTs

APB PATENT RIGHTs. Means Patent Rights that are either (i) assigned solely to APB, (ii) assigned jointly to APB and a party other than ArQule, or (iii) licensed to or otherwise controlled by APB, in each case to the extent that APB has the ability to license or sublicense the rights required under this Agreement without payment to a third party.
