Approval Order

Approval Order. Shall mean an order of the Bankruptcy Court approving this Agreement, whether through a Complying Plan or otherwise.

Approval Order. An order in form and substance satisfactory to Agents approving this Amendment (the "Approval Order");

Approval Order. Means the order of the Bankruptcy Court authorizing and approving the terms in this Agreement which shall, inter alia, prohibit substantive consolidation other than in accordance with Section 5 of this Agreement.

Approval Order. Means the order of the Court, in the form attached as Exhibit A, approving this Settlement Agreement and the transactions and releases contemplated by it.

Approval Order. Shall mean the order or orders of the Court in the Bankruptcy Proceeding approving this Agreement and authorizing the parties to proceed, including the Buyer Protection and Bidding Procedures Order and Sale Order contemplated in Section 5(j).

Approval Order. Means an order of the Bankruptcy C ourt in form and substance reasonably acceptable to the Parties that, among other things, approves the Settlement Agreement and contains the releases set forth herein, it being understood and agreed that the form of order attached hereto as Exhibit A is acceptable to the Parties.

Approval Order. Means an order of the Bankruptcy Court, in form and substance acceptable to the Parties, that, among other things, approves the Settlement Agreement and enjoins the pursuit of Causes of Action released pursuant to this Settlement Agreement against the Peabody Released Parties, it being understood and agreed that the form of order attached hereto as Exhibit A is acceptable to the Parties.

Approval Order. The final, non-appealable order or orders of the Bankruptcy Court, in each case, in form and substance reasonably acceptable to the Administrative Agents, approving the First Lien Repayment and specifically approving the use of proceeds of Loans under the Credit Agreement to effect the First Lien Repayment

Approval Order. That certain final order approving, among other things, this Agreement and entered by the Bankruptcy Court in a form reasonably acceptable to all Parties, which order will include releases and injunctions in favor of all Parties

Approval Order. The order issued by the Delaware Bankruptcy Court granting the Settlement Approval Motion in form and substance acceptable to the Trust, Noble and the D&O Defendants
