Assessed Amounts

Assessed Amounts. Include, without limitation, the amount of any judgments, fines, penalties, ERISA excise taxes or other amounts of any nature whatsoever assessed or levied against Indemnitee in, arising out of or otherwise with respect to any Proceeding. The term "Assessed Amounts" does not include Expenses.
