BEA Software. Shall include Development Software and Deployment Software as defined below. Provided that Licensee is not in material breach of this Agreement and is current in its payment of annual support fees, the BEA Software covered by this Agreement shall also include the object code form of any Maintenance Releases to which Licensee may be entitled.
