Capitalized Terms. Used in this Amendment without definition shall have the meanings given to such terms in the Agreement

Capitalized Terms. Used but not defined in this Amendment shall have the respective meanings ascribed to such terms in the Employment Agreement.

Capitalized Terms. Used in this instrument and not otherwise defined herein shall have the meanings assigned to such terms in the Original Indenture, the First Supplemental Indenture or in the form of Note attached as Exhibit A to the First Supplemental Indenture, as the case may be.

Capitalized Terms. Used in this Fourth Amendment shall have the meanings set forth in the Purchase Agreement, except as otherwise defined herein.

Capitalized Terms. Defined in the Note and not otherwise defined herein shall have the respective meanings provided for in the Note.

Capitalized Terms. Used in this Appendix that are defined in the Plan Document have the meanings given in the Plan Document

Used herein, and not otherwise defined, and abbreviations, shall have the same meaning as in the employment agreement between the parties dated June 1, 2011 as modified by memorandum dated June 23, 2011 (the "Agreement") and this contract is referred to herein as "this Amendment".
