Claim

Claim. Shall mean a claim made by the Buyer against the Seller under this Agreement.

Claim. A claim of the Licensed Patent, which claim has not lapsed, been disclaimed or become abandoned and which claim has not been declared invalid or unenforceable by a court of competent jurisdiction in a decision from which no appeal has or can be taken
