Confirmation

Confirmation. Shall mean the document substantially in the form described in Exhibit C which will list the related Purchase Price with respect to Loans being transferred to Bank from Correspondent on any particular Transfer Date.

Confirmation. Such Confirmation shall constitute conclusive evidence with respect to the Loan, including the number of Units that are the subject of the Loan to which the Confirmation relates, unless Lender provides a written objection to the Confirmation specifying the reasons for the objection to Borrower within five Business Days after the delivery of the Confirmation to Lender.

Confirmation. Has the meaning specified in Paragraph 3(d) (as amended pursuant to the terms hereof).

Confirmation. The documents and other confirming evidence (each a "Confirmation") exchanged between the parties confirming those Transactions.

Confirmation. Means the entry of an Order by the Bankruptcy Court approving the Plan in accordance with the provisions of the Bankruptcy Code.

Confirmation. Means a writing (including facsimile or other electronic means from which it is possible to produce a hard copy, but subject to Section 2.5 below) evidencing an FX Transaction, and specifying: (i) the parties thereto, (ii) the amounts of the Currencies being bought or sold and by which party, (iii) the Value Date, and (iv) any other term generally included in such a writing in accordance with the practice of the relevant foreign exchange market.

Confirmation. Means a confirmation issued by the Lender to the Borrower in respect of the Term Loan in the form attached hereto as Appendix B.

Confirmation. Except as expressly amended by this Amendment, the Services and Secondment Agreement is not modified hereby, is hereby ratified and confirmed, and shall remain in full force and effect.

Confirmation. This Confirmation, the Supplemented Credit Agreement and the other Loan Documents represent the final agreement between the parties and may not be contradicted by evidence of prior, contemporaneous, or subsequent oral agreements of the parties. There are no unwritten oral agreements between the parties.
