Cost Recovery

Cost Recovery. Shall mean that (I) the sum of Disposition Recovery, Land Recovery, and Ownership Recovery, exceeds (II) Infrastructure Costs for any an all phases of the Infrastructure, plus interest on Infrastructure Costs at an annual rate of nine percent, compounded monthly. Cost Recovery shall be determined on a calendar year basis; such determination shall be made by March 31 of each year for the preceding calendar year.
