Covered. , with reference to any WCM Patent Rights or Joint Patent Rights, shall mean that the making, using, selling, offering for sale or importing of a composition of matter or other material or the practicing of a claimed method would infringe a Valid Claim (or, if such Valid Claim has not issued, if such Valid Claim were to issue), within such patent right in the country in which such activity occurs.

Shall mean, with respect to a given product, process, method or service, that a claim of the PATENT RIGHTS would (absent a license thereunder or ownership thereof) be infringed by the making, using, selling, offering for sale, importation or other exploitation of such product, process, method or service. With respect to a claim of a pending patent application, infringed refers to activity that would infringe or be covered by a claim of the PATENT RIGHTS if it were contained in an issued patent.

Covered. (i) with respect to any country, that the use of the 374Water Process to manufacture a Unit in such country would, infringe any claim of a 374Water Patent or (ii) that the use of the 374Water Process to manufacture a Unit requires the use of the 374Water Know-How
