Currently Scheduled Termination Date

Currently Scheduled Termination Date. Shall mean December 31, 1997, as such date may be extended in writing by written agreement of NCT, Marblehead and the Program Lender, given in each party's sole and absolute discretion no later than ninety days prior to the then Currently Scheduled Maturity Date.

Currently Scheduled Termination Date. Shall mean May 31, 2004, provided, however, that such date shall automatically be extended for an additional year on such date and each anniversary thereof, unless (a) any party shall have given notice of termination at least one hundred eighty (180) days prior to the end of the then-current term or (b) as otherwise permitted under the definition of "Termination Date," in which case the termination set forth in such notice shall govern.
