Defect

Defect. With respect to the API shall mean failure of the API to comply with the Product Specifications.

Defect. Shall mean any failure, malfunction, defect or non-conformity in the RMSS Software that prevents the RMSS Software from operating and performing in any material respect in accordance with the Documentation.

Defect. Means with respect to a Product, that such Product has not been Manufactured or Delivered in accordance with (a) the applicable Specifications for such Product, (b) cGMP or the requirements under the Quality Agreement or (c) Applicable Law in the countries in which they are Manufactured;

Defect. Means any failure of the Licensed Technology to substantially perform in accordance with the corresponding situation.

Defect. Means, in respect of a Product, a failure to comply with the applicable Specification and/or to have been manufactured in accordance with cGMP, and "Defective" shall be construed accordingly.

Defect. Means a defect, failure, malfunction, or nonconformity in a Deliverable that prevents the Deliverable from operating in accordance with the applicable Acceptance Criteria.

Defect. The term "Defect" shall mean any material failure of the Product to conform to the applicable specifications for the Product, as set forth on Schedule B, at the time of its shipment by the MANUFACTURER.

Defect. Shall mean any failure, malfunction, defect or non-conformity in the SoftPro Software that prevents the SoftPro Software from operating and performing in any material respect in accordance with the Documentation.

Defect. Shall have the meaning ascribed thereto in Paragraph 10.
