Derivative Work

Derivative Work. Means all works developed by LICENSEE which would be characterized as derivative works of the Licensed Software under the United States Copyright Act of 1976, or subsequent revisions or amendments thereof or successors thereto, specifically including, but not limited to, translations, abridgements, condensations, recastings, transformations, enhancements, new releases, or adaptations of the Licensed Software, or works Confidential treatment has been requested for portions of this exhibit. Derivative Work. Means any modification, translation, port, adaptation, extension, improvement, compilation, abridgment or other form in which the Licensor's Licensed Products may be recast, transformed or adapted for use, including but not limited to any form which would infringe any copyright to the Licensor's Licensed Products but for the license granted herein.

Derivative Work. Means any work based on or incorporating all or any portion of a Product, including mechanical or electronic reproduction, translation, adaptation, change of media or other form, which would represent a violation of MEDecision's (or its supplier's) intellectual property rights if done without MEDecision's consent.

Derivative Work. Means any discrete modification to the Software made by Licensee pursuant to this agreement and any modified, altered, enhanced or adapted version of the Software, or derivative work thereof (as that term is defined under United States copyright law) based on the Software.
