Effective Date

Effective Date. The date on which the registration statement covering the resale of the Shares and the Warrant Shares is initially declared effective by the SEC.

Effective Date. Means the date when any and all conditions to the effectiveness of the Plan have either been satisfied or waived by Accentia as provided in the Plan. The Parties acknowledge that in the event that, prior to the Effective Date ABPI converts the Reorganization Proceeding from Chapter 11 to Chapter 7, or liquidates a majority of its assets under Chapter 11, the revenue sharing provisions of Paragraph 3 shall not vest.

Effective Date. Means the earlier of (i) the effective date of a registration statement (the Registration Statement) registering for resale by the Holder all of the Warrant Shares or (ii) January 31, 2010.

Effective Date. Shall mean March 31, 2006.

Effective Date. The later of (i) the date first set forth above in this Agreement or (ii) the date on which the condition set forth in Section 2.4 hereof has been satisfied

Effective Date. Shall mean the date on which an authorized representative of INALCO certifies in a writing delivered to CUMBERLAND that INALCO has met all requirements in order to transfer exclusive marketing and distribution rights to the Product in accordance with this Agreement, including without limitation, obtaining all rights to the Trademarks from Mylan Pharmaceuticals, Inc.; provided that such certificate must be in a form reasonably satisfactory to CUMBERLAND.

Effective Date. Means the date on which occurs the 'Effective Time' as defined in the Merger Agreement

Effective Date. The date upon receiving stockholder approval at the Company's annual meeting in accordance with Section 19.11 hereof
