Eligible Associate

Eligible Associate. Shall mean an Officer at such times that Officer is eligible to participate in this Plan as provided in Section 3 of this Plan. 10

Eligible Associate. Means any employee of the Company or an Affiliate whose customary employment is at least 20 hours per week and who has been employed by the Company or an Affiliate for at least 90 consecutive days prior to the first day of the relevant Purchase Period; provided, however, that "Eligible Associate" shall not include any person who would be deemed, for purposes of Section 423(b)(3) of the Code, to own stock possessing 5% or more of the total combined voting power or value of all classes of stock... of the Company.
