GENVEC PATENT RIGHTS. Shall mean (i) all patents and patent applications listed on Exhibit A hereto, or conceived and reduced to practice by GenVec alone, or GenVec and/or its agents (including researchers at DFCI) in connection with the Research Program during the Research Program Term, and (ii) any divisions, continuations, continuations-in-part, reissues, reexaminations, extensions or other governmental actions which extend any of the subject matter of the patent applications or patents in (i) above, and any... substitutions, confirmations, registrations or revalidations of any of the foregoing, in each case, which is owned or controlled, in whole or part, by license, assignment or otherwise by GenVec, to the extent GenVec has the right to license or sublicense, and subject to any limitations of such license or sublicense.
