Hazardous Waste
Hazardous Waste. Shall mean waste arising from the manufacture and packaging of the Product that is defined as "Hazardous" by applicable federal, state, provincial or local laws, rules or regulations and may include Product properly rejected pursuant to Section 4.12 hereof, but shall not include any other returned Product.

Hazardous Waste. And "DISPOSE" shall have the meanings specified in RCRA, or any successor statute, unless such terms have been given broader meaning by laws, regulations, rules, orders, ordinances, requirements or determinations of any governmental authority of the State of Texas having jurisdiction (including courts establishing common law liability), in which case such broader meaning shall apply.
