HOKU Background Intellectual Property

HOKU Background Intellectual Property. Means any and all Intellectual Property conceived or developed by HOKU prior to or outside the scope of this Agreement. "HOKU Background Intellectual Property" includes such Intellectual Property that is owned by HOKU under the Engineering Agreement and the Collaboration Agreement.
