Holders of Exchange Shares

Holders of Exchange Shares. The Exchanging Creditors that have entered into an Exchange and Release Agreement with the Company pursuant to which each such Person has agreed to convert and exchange all or a portion of the Company Debt held by such Person for, and therefore as of the Closing will be the holder and owner of, Exchange Shares, and includes the respective successors and permitted assigns provided for in Section 13.
