Ineligible Employee. An Employee who, as of an Offering Commencement Date: (1) is a Five Percent Owner; (2) has been continuously employed by a Participating Company on a full-time basis for less than 90 days; (3) has been continuously employed by a Participating Company on a part-time basis for less than one year; or (4) is restricted from participating under Paragraph 3(b).
