Initially capitalized words or terms

Initially capitalized words or terms. Used in this Amendment and not defined herein shall have the meaning ascribed to the same in the Seller Note Securities Purchase Agreement except that any initially capitalized words or terms used in Section 2 of this Amendment and not defined therein shall have the meaning ascribed to the same in the Rights Agreement.
