Investment Manager. The collective reference to Thomas Weisel Partners LLC, Mellon Bond Associates (together with its successors) and UBS Paine Weber and any other entity designated in writing as an "Investment Manager" by the Secured Party and the Pledgor to the Securities Intermediary. As of the date of this Agreement, Thomas Weisel Partners LLC is the acting Investment Manager with respect to the Cash Collateral Account.
