Lawsuit. Refers to the case of The University of Colorado Foundation, Inc., et al. v. American Cyanamid Company, Civil Action No. 93-K-1657, in which the Judgment was entered by the Court and all related post-trial proceedings.

Lawsuit. That certain lawsuit styled Liberty Renewable Fuels, L.L.C. v. Mark Bateman, Renewable Energy Consultants, L.L.C., Rick Chesak, and Cindy Brearley, Case No. 06-04131-C, and filed in the 35th Circuit Court of Shiawassee County, Michigan.

Lawsuit. Means the civil action filed by Aventis and King against Cobalt in the United States District Court for the District of Massachusetts captioned Aventis Pharma -2- Deutschland GMBH and King Pharmaceuticals, Inc. v. Cobalt Pharmaceuticals, Inc., Civil Action No. 03-10492JLT.

Lawsuit. Means Medicis Pharmaceutical Corporation v. Barr Laboratories, Inc. and Teva Pharmaceuticals USA. Inc., Civil Action No. 1:09-cv-03464-JFM, in the United States District Court for the District of Maryland.
