Maximum Leverage Ratio. That ratio of the Corporation's aggregate Indebtedness (excluding, for the purposes of clarity, the Preferred Stock) to its trailing twelve month Adjusted EBITDA is equal to or less than, (A) during the first twelve (12) calendar months immediately following the Original Issue Date, 6x, and (B) at any after the completion of the first twelve (12) calendar months following the Original Issue Date, 5.5x.
