Modification

Modification. Shall mean any customization, enhancement, modification or change made to the RMSS Software authored by or for RMSS under this Agreement.

Modification. A duly executed (i) written amendment to the Agreement or any Purchase Order; (ii) Change Order; or (iii) Company-written order for a minor change not requiring a Change Order pursuant to this Agreement.

Modification. But not otherwise defined or limited herein shall have the meanings set forth in the Notes, as amended hereby.

Modification. A change to the Product, as further provided in Article 3.3.

Modification. The Agent and the Lenders hereby modify the Agreement as follows: (a) Section 9.10 entitled "Consolidated Capital Expenditures" is deleted in its entirety and replaced with the following: "9.10 Consolidated Capital Expenditures. Make Consolidated Capital Expenditures, other than for any Permitted Acquisition, exceeding in the aggregate $40,000,000 for the Borrower and all Subsidiaries in any one fiscal year of the Borrower."

Modification. Except to the extent otherwise specified herein, capitalized terms used in this Modification shall have the same meanings specified in the Agreement.

Modification. Capitalized terms used in this Modification shall have the meanings provided in the Agreement unless otherwise stated herein. No provisions of the Agreement are modified, amended, waived or otherwise effected by this Modification except as expressly set forth in this Modification. All provisions of the Agreement not expressly modified herein shall apply equally to this Modification. The Agreement as modified by this Modification shall be construed together as a whole.

Modification. Any customization, enhancement, modification or change made to the Service authored by or for ACL Group, Inc. under this Agreement.
