New Outside Technology

New Outside Technology. Shall mean any technology that, as of the Effective Date, is not embodied in any released or beta test product of the Company or would be reasonably deemed to be within the Company's long-term business plan. Without limitation, a technology will be deemed embodied in a product if the product or its use would infringe the associated intellectual property rights owned or controlled by the Company.
