Example Definitions of "Nominating Seller Party"
Nominating Seller Party. Means a Seller Party that, together with its Affiliates, beneficially owns at least five percent (5%) of the Company's outstanding Common Stock at the time when the determination is made (subject in all cases to Section 3.1(C) and (D) hereof).
Nominating Seller Party. Means a Seller Party that, together with its Affiliates, holds at least five percent (5%) of the Company's outstanding Common Stock at the time when the determination is made.
