Note Trustee

Note Trustee. Shall mean The Bank of New York, a New York banking corporation, in its capacity as trustee and collateral agent pursuant to the Note Indenture and the other Noteholder Agreements, and its successors and assigns, including any replacement or successor trustee or agent acting for or on behalf of the Noteholders or pursuant to the Note Indenture or any additional trustee or agent.
