Operative Time

Operative Time. The consummation of the Share Distribution (as defined in the Investment Agreement) on the closing date of the Transactions (the "Operative Time"), following which the Company will notify the Trustee that such Operative Time has occurred and that this Supplemental Indenture has become effective.
