Other Rate Early Opt-in
Other Rate Early Opt-in. Bank and Borrower Agent have elected to replace LIBOR with a Benchmark Replacement other than a SOFR-based rate pursuant to (a) an Early Opt-in Election and (2) Section 3.9(b) of the Sixth Amendment and clause (b) of the definition of Benchmark Replacement.
