Overpayment

Overpayment. The amount of money LHC has received in excess of the amount due and payable under any Federal health care program requirements.

Overpayment. The amount of money Amedisys has received in excess of the amount due and payable under any Federal health care program requirements, as determined by the IRO in connection with the claims reviews performed under this Appendix B, and which shall include any extrapolated Overpayments determined in accordance with Section A.3 of this Appendix B.

Overpayment. As a result of the uncertainty in the application of Section 4999 of the Code at the time of the initial determination by the Accountants hereunder, it is possible that (i) Gross-Up Payments which will not have been made by the Company should have been made (an "Underpayment"), consistent with the calculations required to be made hereunder or that (ii) Gross-Up Payments that have been made will be determined to have been in excess of the Gross-Up Payments actually required (an "Overpayment").

Overpayment. The amount of money Odyssey Hospice has received in excess of the amount due and payable under any Federal health care program requirements.

Overpayment. Amounts will have been paid or distributed by the Company to or for the benefit of Covered Person pursuant to this Agreement which should not have been so paid or distributed

Overpayment. The amount of money Hill-Rom has received in excess of the amount due and payable under the Medicare program requirements.

Overpayment. The amount of money VITAS has received in excess of the amount due and payable under Medicare requirements, as determined by the IRO in connection with the reviews performed under this Appendix B.

Overpayment. The amount of money 21st Century has received in excess of the amount due and payable under Medicare and TRICARE program requirements, as determined by the IRO in connection with the review of claims performed under this Appendix B, including any extrapolated Overpayments determined in accordance with Section A.3 of this Appendix B.

Overpayment. The amount of money Progenity has received in excess of the amount due and payable under Medicare, any state Medicaid program requirements, or TriCare, as determined by the IRO in connection with the Claims Review performed under this Appendix C.

Overpayment. The amount of money a Subject Facility or Facilities have received in excess of the amount due and payable under Medicare program, a state Medicaid program, or the TRICARE program requirements, as determined by the IRO in connection with the Claims Review performed under this Appendix B.
