Parity Stock

Parity Stock. Any class or series of stock of the Corporation (other than Designated Preferred Stock) the terms of which do not expressly provide that such class or series will rank senior or junior to Designated Preferred Stock as to dividend rights and/or as to rights on liquidation, dissolution or winding up of the Corporation (in each case without regard to whether dividends accrue cumulatively or non-cumulatively)

Parity Stock. The Company's Series A Preferred Stock, the Company's Series C Preferred Stock and any class or series of stock of the Corporation authorized after the date of issuance of the Series D Preferred Stock in accordance with Section 6(b) hereof ranking on a parity with the Series D Preferred Stock in respect of the right to receive dividends or the right to participate in any distribution upon liquidation

Parity Stock. Any shares of any class or series of Stock of the Corporation having any preference or priority as to dividends or liquidation, dissolution or winding up equal to or pari passu with any such preference or priority of the 2008 Senior Preferred and any instrument or security convertible into or exchangeable for Parity Stock.

Parity Stock. (a) for purposes of Section 2 below, the Series A Preferred Stock of the Corporation and any other class or series of stock of the Corporation that, with respect to a particular class or series of stock of the Corporation, is entitled to receive payment of dividends on a parity with the referenced class or series of stock, and (b) for purposes of Section 3 below, the Series A Preferred Stock of the Corporation and any other class or series of stock of the Corporation that, with respect to a... particular class or series of stock of the Corporation is entitled to receive assets upon the liquidation, dissolution or winding up of the affairs of the Corporation on a parity with the referenced class or series of stock. Parity Stock. Means any class of Capital Stock or series of preferred stock of the Company established after the Original Issue Date by the Board of Directors and in accordance with the terms hereof, the terms of which expressly provide that such class or series will rank on parity with the Preferred Stock as to dividend rights or rights upon a Liquidation or payments rights on a Change of Control

Parity Stock. Means any outstanding class or series of Preferred Stock of the Corporation ranking, in accordance to its terms, as to dividends and upon voluntary or involuntary liquidation, dissolution or winding-up of affairs of the Corporation on parity with the Series G Preferred Stock.

Parity Stock. Each class or series of the Corporation's capital stock established hereafter by the Board of Directors the terms of which provide that such class or series will rank on a parity with the Series A Senior Preferred Stock as to the payment of dividends or distributions upon liquidation, winding up and dissolution. Parity Stock includes warrants, rights, calls or options exercisable for or convertible into Parity Stock.

Parity Stock. Shares of any series of the Corporation's Preferred Stock and any shares of Capital Stock ranking as to dividends and/or as to the rights in liquidation, dissolution or winding-up of the affairs of the Corporation equally with the Series A Preferred Stock

Parity Stock. Shall mean any class or series of the Corporation's Capital Stock established after the Initial Issue Date, the terms of which expressly provide that such class or series will rank on parity with the Series A Preferred Stock as to dividend rights, redemption rights or distribution rights upon the liquidation, winding up or dissolution or other Insolvency or Liquidation Proceeding of the Corporation.
