Participating Employee

Participating Employee. An employee (i) for whom payroll deductions are currently being made or who otherwise contributes to the Plan, or (ii) for whom payroll deductions are not currently being made or who does not otherwise contribute to the Plan because he or she has reached the limitation set forth in the first sentence of Section 6

Participating Employee. Any person employed by the Company or any affiliate of the Company and designated by the Retirement Committee of the Company as a highly compensated employee under the Retirement Plan, such as that term is defined in Code Section 414(q) and as referenced in section 1.30 of the Retirement Plan.
