Phytogen Proprietary Rights

Phytogen Proprietary Rights. Shall mean all intellectual property rights including, without limitation, patents, patent applications, copyrights, know-how, and trade secrets, that (a) are Controlled by Phytogen at any time during the term of this Agreement, and (b) relate to, claim or cover the Product, including without limitation the composition of matter of the Product and the method of making or using the Product.
