Example Definitions of "Prepackaged Plan"
Prepackaged Plan. A prepackaged plan of bankruptcy under Chapter 11 of the United States Bankruptcy Code prepared by the Company to be implemented in the event that insufficient tenders of Notes and consents have been received from the Noteholders to satisfy or cause the Company to waive the Minimum Tender Condition, but sufficient votes of an accepting class under section 1126 of the United States Bankruptcy Code have been received.
Prepackaged Plan. Means the plan of reorganization of the Company substantially consistent with the terms set forth in the Term Sheet and in form and substance acceptable to the Required Supporting Noteholders.
Prepackaged Plan. Means the prepackaged chapter 11 plan of reorganization of the Company (including any annexes, supplements, exhibits, term sheets, or other attachments attached thereto, which will be consistent in all respects with the Term Sheet and this Agreement and otherwise reasonably acceptable to the Company and Requisite Term Lenders), to be implemented in the Restructuring in accordance with and subject to the terms and conditions of this Agreement, including the Term Sheet
Prepackaged Plan. Means the joint prepackaged plan of reorganization of the Cubic Parties, and each of the documents, schedules and agreements attached hereto, in the form attached hereto as Exhibit A, and as may be amended, modified or supplemented only in accordance with the terms hereof and thereof.
