Recall

Recall. Means a "recall", "correction" or "market withdrawal" and shall include any post-sale warning or mailing of information.

Recall. , with respect to any Product, shall mean a "recall", "correction" or "market" withdrawal, as those terms are defined in 21 CFR 7.3, as the same may be amended from time to time, and shall include any post-sale warning or mailing of information regarding such Product, including those warnings or mailings described in 21 CFR 200.5.

Recall. Means any action by Purchaser and its Affiliates, or Supplier and its Affiliates, to recover title or possession or halt distribution, prescription, or consumption of Product sold or shipped to Third Parties. The term "Recall" also applies to Product that would have been subject to recall if it had been shipped.

An instance where: (i) a request, directive or order of any government authority is received by Wellness or Mannatech that Product be recalled; (ii) a court of competent jurisdiction orders such a Recall; or (iii) Mannatech reasonably determines that Product should be recalled due to evident facts which would otherwise lead to actions referred to under (i) and/or (ii).

Recall. Means any action by any Party to recover title to or possession of any Product sold or shipped to Third Parties or any action to prevent or interrupt the sale or shipment by a Party of the Product to Third Parties that would have been subject to recall if it had been sold or shipped.
