Restrictive Covenant

Restrictive Covenant. The restrictive covenants set forth in the Employment Agreement;

Restrictive Covenant. Means the restriction included in that certain Covenant and Agreement dated February 14, 1994, recorded in Official Records Book 21856, Page 556 of the Public Records of Broward County, Florida, which prohibits the use of the Center for a real estate sales or brokerage office.

Restrictive Covenant. Shall mean a reasonable restriction, not to exceed three years in duration, on the Executive to engage in conduct competitive with a business, subsidiary or division of the Company.

Restrictive Covenant. Means any non-competition, non-solicitation, confidentiality, non- disparagement, non-disclosure, or similar agreement between a Participant and the Company or an Affiliate.

Restrictive Covenant. Means any of the restrictive covenants set forth in Exhibit A, which is incorporated herein by reference. As used herein with respect to the Option, the term "vest" means to become exercisable in whole or in specified part.

Restrictive Covenant. Any of the covenants set forth in Sections 6, 7, 8 and 9 hereof; provided, that if Employee is party to an existing employment agreement with the Company or any of its Subsidiaries as of the date hereof and such employment agreement contains a covenant of the type covered under Sections 6, 7 or 8 hereof, such restrictive covenant shall be incorporated herein by reference and the corollary of such restrictive covenant set forth herein shall not be deemed to apply to the Employee.
