Example Definitions of "Royalty Stream"
Royalty Stream. Means: (i) six percent (6%) of Net Sales for all Products that are not FDA Products; (ii) seven percent (7%) of Net Sales for all FDA Products, excluding the SinuNase Formulation; and (iii) fourteen percent (14%) of Net Sales for the SinuNase Formulation. Payments of the Royalty Stream shall be made on a quarterly basis in accordance with Section 6. Royalty Stream. Means fifty percent (50%) of all Royalty Payments required to be paid by Accentia under the License Agreement. Notwithstanding the forgoing, Royalty Stream shall not include Royalty Payments that are payable by Accentia under the License Agreement that are based on the sale of products exclusively intended to treat asthma.
