Section 13 Event

Section 13 Event. ; provided, however, that, notwithstanding anything in this Agreement to the contrary, a Section 13 Event shall be deemed not to have occurred solely as a result of (x) the execution and delivery of the Merger Agreement or (y) the consummation of the Merger or any of the other transactions contemplated by the Merger Agreement

Section 13 Event. Shall mean any event described in clause (i), (ii) or (iii) of Section 13(a) of this Agreement.
