Terms

Terms. All terms used herein but not otherwise defined herein shall have the meanings set forth and/or defined in the Lease, unless specifically indicated herein to the contrary.

Appearing in initial capital form and not otherwise defined herein shall have the meaning ascribed to them in that certain Amended and Restated Securities Purchase Agreement, dated as of the date hereof, by and among the Holder, the Borrower and the other purchasers named therein, and solely for purposes of Section 9 thereof, Steel Pier Capital Advisors, LLC, as collateral agent, and to which this Note is attached as Exhibit A thereto (the "Securities Purchase Agreement").
