Variable Rate Tariff

Variable Rate Tariff. A variable rate tariff on terms that have been proposed by Maker and consented to by Payee (such consent not to be unreasonably withheld or delayed) and that is otherwise based upon a debt coverage ratio sufficient to produce at least 1.2 times the debt service obligations of Maker and that takes into account Maker's obligations under an Operation, Maintenance and Administrative Services Agreement with Cap Rock Energy Corporation and its other operation and maintenance obligations.
