Affiliate

Affiliate. Of a Person, or a Person "affiliated" with such Person, shall mean any Person that, directly or indirectly through one or more intermediaries, Controls, is Controlled by, or is under common Control with, such Person.

Affiliate. Any Person that directly, or indirectly through one or more intermediaries, controls or is controlled by or is under common control with the party specified (it being understood and agree that from and after the Closing, for purposes of this Agreement, none of the Company or any of its Subsidiaries shall be deemed to be an Affiliate of iSystems or any of its Affiliates)

Affiliate. Any other Person directly or indirectly controlling or controlled by or under common control with such Person. For purposes of this definition, control when used with respect to any Person has the meaning specified in Rule 12b-2 under the Exchange Act (including Commission and judicial interpretations thereof); and the terms controlling and controlled shall have meanings correlative to the foregoing.

Affiliate. Means, with respect to any Person, any "affiliate" of such Person, as such term is defined in the Bankruptcy Code; provided, however, that in respect of Borrower or Guarantor the term "Affiliate" shall not include BlackRock, Inc. or Highfields Capital Investment LLC.

Affiliate. Shall mean any entity directly or indirectly controlled by, controlling or under common control of the Bank or FIB or any corporation or other entity acquiring, directly or indirectly, all or substantially all the assets and business of the Bank or FIB, whether by operation of law or otherwise.

Affiliate. Means, with respect to any Person, any other Person, directly or indirectly, through one or more intermediaries, Controlling, Controlled by, or under common Control with, such Person. Affiliate. A Person which is controlled by the Company or its corporate successor, which controls the Company or its successor, or which is under common control with the Company or its successor (direct or indirect ownership of more than fifty percent (50%) of the voting power constituting "control" of a Person for such purpose)
