Agreement

Agreement. Means this Limited Liability Company Operating Agreement of JAVO DISPENSER, LLC, as it may be amended, supplemented or restated from time to time.

Agreement. Means the Amended and Restated Agreement dated as of February 3, 2010, by and among the Company, CapStone Investments and Fletcher pursuant to which five thousand (5,000) shares of Series A-1 Preferred Stock and a warrant are to be issued by the Company, including all schedules and exhibits thereto.

Agreement. Unless otherwise specifically defined herein, each term used herein which is defined in the Agreement has the meaning assigned to such term in the Agreement.

Agreement. Shall mean this Elestat™ (Epinastine) Co-Promotion Agreement together with all appendices, exhibits and schedules hereto, as the same may hereinafter be amended or supplemented from time to time in accordance with the Agreement.

Agreement. Means this Agreement and the annexes and exhibits hereto.

Agreement. This Employee Restricted Shares Agreement between the Participant and the Company.

Agreement. All references to the "Agreement" or the "Credit Agreement" in the Original Credit Agreement and in this Agreement shall be deemed to be references to the Original Credit Agreement as it may be amended (by this Agreement and others), restated, extended, renewed, replaced, or otherwise modified from time to time.

Agreement. Asset Purchase Agreement, dated as of June 7, 2009

Agreement. Shall mean this license agreement together with the preliminary statements and all exhibits, schedules and attachments hereto.

Agreement. Terms defined in the Agreement and delineated herein by initial capital letters shall have the same meaning ascribed thereto in the Agreement, except to the extent that the meaning of such term is specifically modified by the provisions hereof.
