Competing Product

Example Definitions of "Competing Product"
Competing Product. Any product or service which is sold or provided in competition with a product or service: (A) that Orion has sold or provided at any time during the twelve (12) months immediately preceding the Termination Date or (B) that was designed, developed, tested, distributed, marketed, provided or produced by Orion at any time during the twelve (12) months immediately preceding the Termination Date.
Competing Product. Any product or service which is sold or provided in competition with a product or service: (A) that Orion has sold or provided at any time during the twelve (12) twenty-four (24) months immediately preceding the Termination Date or (B) that was designed, developed, tested, distributed, marketed, provided or produced by Orion at any time during the twelve (12) twenty-four (24) months immediately preceding the Termination Date.

Competing Product. Any product, not covered by any license granted hereunder, that incorporates the Compound as an active pharmaceutical ingredient prepared or combined with or formulated using Captisol as a solubilizing agent for ultimate use in humans within the Field

Competing Product. Means any product, item or Improvement which competes or potentially competes with the Product including any Product Accessory or any product or item conceived of in connection with the Research and Development Agreement or which constitutes an Improvement to the Product including any Product Accessory or other improvement to any product or item conceived of in connection with the Research and Development Agreement.
Competing Product. Any product or service, in existence or under development, which is of the same type as, which competes with, or which is intended to compete with or displace in the market, any of the products or services provided or sold (or contemplated to be provided or sold) by the Beacon Group.
Competing Product. Means any product, method, process, or other subject matter that is, or readily can be, applied, used, or adapted for any application or use in substitution for or competition with any Joint Development Product (as defined below)
