Disclosure Statement. The disclosure statement in respect of the Plan describing, among other things, the Restructuring and the other transactions contemplated by the Term Sheet

Disclosure Statement. Means the disclosure statement in respect of the Plan.

Disclosure Statement. Disclosure statement for the purposes of section 1125 of the Bankruptcy Code in support of the Agreed Plan and the transactions contemplated by this Agreement and the Summary Term Sheet

Disclosure Statement. Means a disclosure statement with respect to the Prepackaged Plan, and that satisfies the requirements of section 1125 of the Bankruptcy Code, in the form attached hereto as Exhibit E, and as may be amended, modified or supplemented only in accordance with the terms hereof.

The disclosure statement in respect of the Plan which shall be consistent in all material respects with this Agreement and the Recapitalization Term Sheet and otherwise in form and substance reasonably acceptable to the Company and the Required Consenting Subordinated Noteholders

Disclosure Statement. The disclosure statement for the Joint Plan, as amended, supplemented, or otherwise modified from time to time, that describes the Joint Plan and is prepared and distributed in accordance with, among other things, sections 1125, 1126(b), and 1145 of the Bankruptcy Code, rule 3018 of the Federal Rules of Bankruptcy Procedure and other applicable law, and which shall be materially consistent with this Agreement

Disclosure Statement. A disclosure statement with respect to the Plan consistent with the requirements of section 1125 of the Bankruptcy Code

Disclosure Statement. Means the disclosure statement in respect of the Plan, in form and substance reasonably satisfactory to the Requisite Creditors, which is prepared and distributed in accordance with sections 1125, 1126(b) and/or 1145 of the Bankruptcy Code, Bankruptcy Rules 3016 and 3018 and/or other applicable law including, without limitation, all exhibits and schedules thereto, as approved or ratified by the Bankruptcy Court pursuant to section 1125 of the Bankruptcy Code. References to "Disclosure... Statement" hereunder shall include all amendments, restatements and other modifications made thereto following the Commencement Date in accordance with this Agreement.
