Fifth Amendment

Fifth Amendment. Means the Fifth Amendment to Credit Agreement among the Borrower, the Agent and the Lenders dated as of February 25, 2002.

Fifth Amendment. Unless otherwise defined in this Fifth Amendment, all capitalized terms shall have the same meanings as are ascribed to those terms in the Lease.

Fifth Amendment. That certain Fifth Amendment to Debtor-In-Possession Credit and Security Agreement, dated as of April 25, 2008, among the Parent, the Borrower, the Lenders and the Agents and as acknowledged and agreed by the Guarantors.

Fifth Amendment. Means the fifth amendment to this Agreement, dated as of August 25, 2008, by and among Parent, and the Borrowers, the other Credit Parties thereto from time to time, as Guarantors, the Lenders, the Administrative Agent, the Revolving Agent, and the Collateral Agent.

Fifth Amendment. Shall mean Amendment No. 5 to Loan and Security Agreement, dated as of June 30, 2005, by and among the Borrowers, the Agent and the Lenders.

Fifth Amendment. That certain Fifth Amendment to Amended and Restated Loan and Security Agreement, dated of even date herewith, among the Loan Parties and the Senior Lender (the "Fifth Amendment")

Fifth Amendment. Means that certain agreement entitled "Fifth Amendment to Credit Agreement" entered into by and between the Company and the Bank dated as of January 30, 2005, for the purpose of amending this Agreement.

Fifth Amendment. Means that certain Fifth Amendment to Amended and Restated Credit Agreement by and among the Borrower, the Lenders and the Administrative Agent dated as of March 23, 2009.

Fifth Amendment. Means the Fifth Amendment and Waiver to Amended and Restated Credit Agreement, dated as of May 20, 2009, among the Borrower, the Parent, certain other Obligors, the Lenders party thereto and the Administrative Agent.

Fifth Amendment. Fifth Amendment" means that certain Fifth Amendment to Credit and Security Agreement dated as of November 22, 2002 between Borrower and Lender.
