Fifth Amendment

Fifth Amendment. Means that certain Fifth Amendment dated as of December 4, 2009 by and among the US Borrower, the Canadian Borrower, the other Loan Guarantors party thereto, the Lenders party thereto, the US Administrative Agent and the Canadian Administrative Agent.

Fifth Amendment. Means that certain Fifth Amendment to Credit Agreement by and among Borrower and Bank dated June 29, 2012.

Fifth Amendment. That certain Fifth Amendment to Credit Agreement, dated as of April 6, 2010, among the Parent, the Borrower, the Guarantors, the Administrative Agent and the Lenders party thereto.

Fifth Amendment. Means the Fifth Amendment to Credit Agreement dated as of December 28, 2001 by and between the Borrower and the Bank.

Fifth Amendment. All capitalized terms used herein shall havethe same meanings as used in the Credit Agreement, unless otherwise defined in this Fifth Amendment and the rules of construction set forth in the Credit Agreement shall apply to this Fifth Amendment.

Fifth Amendment. Shall mean the Fifth Amendment to Loan and Security Agreement, dated September 28, 2007, by and among Borrower, Obligor and Bank.

Fifth Amendment. Means that certain Fifth Amendment to Credit Agreement, dated on or about July 19, 2012, among the Administrative Agent, the Lenders and the Borrowers.

Fifth Amendment. Means the Fifth Amendment to this Agreement entered into as of June 24, 2005, among the Company, BNP Paribas and the Purchasers party thereto.

Fifth Amendment. Herein shall have the meaning ascribed to them in the Lease Agreement
