Holder

Holder. Means any holder of record of Registrable Common Stock (as defined below). For purposes of this Agreement, the Company may deem and treat the registered holder of Registrable Common Stock as the Holder and absolute owner thereof, and the Company shall not be affected by any notice to the contrary.

Holder. Or "Holders" means the holder or holders of the Series A Preferred Stock.

Holder. Means (i) any Person in whose name a Note or a Warrant is registered from time to time, or (ii) if the Note or the Warrant is held by a financial intermediary for the benefit of other Persons, such other Persons as indicated in the records of such financial intermediary.

Holder. Shall mean (i) each Purchaser, and (ii) any other Person holding Registrable Securities to whom the registration rights conferred by this Agreement have been transferred in compliance with this Agreement.

Holder. Berg and any permitted transferee or assignee who agrees to become bound by the provisions of this Agreement in accordance with Section 3 hereof and who holds Registrable Securities, as the context may require.

Holder. Shall mean a holder of record of an outstanding share or shares of the Series D Preferred Stock.

Holder. Shall mean an Employee to whom an Option has been granted.

Holder. Shall mean (i) an Investor; (ii) Hercules; or (iii) a transferee to whom registration rights granted under this Agreement are assigned in accordance with this Agreement.

Holder. Means any person owning or having the right to acquire Registrable Securities, including initially each Purchaser and thereafter any permitted assignee thereof;

Holder. Means, when used with respect to any Security, the Holder (as defined in the Indenture) and, with respect to any Common Stock, the record holder of such Common Stock.
